Assumption of Risk, Waiver of Liability, and Indemnification Agreement

Please read this document carefully — it affects your legal rights.

1. VOLUNTARY PARTICIPATION. I acknowledge that my participation in Southeast Senior Pro League (“SSPL”) events, activities, practices, and related functions is entirely voluntary. I am under no obligation to participate and I choose to do so of my own free will.

2. ELIGIBILITY ACKNOWLEDGMENT. I affirm that I meet the age and eligibility requirements established by SSPL for the current season, including the minimum age requirements for senior league participation.

3. ASSUMPTION OF RISK. I acknowledge that participation in pickleball activities and SSPL events involves inherent risks that cannot be entirely eliminated. These risks include, but are not limited to:

Falls, collisions with other players, nets, fences, walls, or other structures
Impact injuries from paddles, balls, or other equipment
Muscle strains, sprains, fractures, dislocations, ligament or tendon injuries
Heat-related illness, dehydration, sunburn, and weather-related conditions
Cardiac events, respiratory distress, or aggravation of pre-existing conditions
Eye injuries from ball or paddle impact
Injuries arising from court surface conditions, including wet, uneven, or slippery surfaces
Injuries sustained in parking areas, spectator areas, walkways, and other venue premises

I voluntarily assume all such risks, both known and unknown, even if arising from the negligence of the Released Parties (as defined in Section 5), and accept full responsibility for my participation.

4. TRAVEL AND TRANSPORTATION. I acknowledge that SSPL events are held at various locations and that travel to and from these events is my sole responsibility. I release and discharge the Released Parties from any and all claims arising out of or related to my travel.

5. WAIVER AND RELEASE OF LIABILITY. In consideration of being permitted to participate in SSPL events, I hereby waive, release, and forever discharge, to the fullest extent permitted by law, the Southeast Senior Pro League, its organizers, board members, officers, coordinators, team captains, volunteers, sponsors, host facilities, venue owners and operators, and their respective agents, employees, successors, and representatives (collectively, “Released Parties”) from any and all claims, demands, causes of action, damages, losses, or liabilities of any kind whatsoever, whether known or unknown, foreseen or unforeseen, arising out of or related to my participation in SSPL activities. This release includes, without limitation, claims for personal injury, property damage, illness, emotional distress, or wrongful death, whether caused by the negligence of the Released Parties or otherwise. This release does not apply to claims arising from the gross negligence, willful misconduct, or intentional acts of the Released Parties.

6. INDEMNIFICATION AND HOLD HARMLESS. I agree to indemnify, defend, and hold harmless the Released Parties from any and all claims, liabilities, damages, costs, or expenses (including reasonable attorney’s fees and court costs) arising from or related to: my participation in SSPL activities; any breach of the representations or terms in this agreement; or any act or omission by me that results in injury or damage to another person or their property.

7. MEDICAL FITNESS AND EMERGENCY AUTHORIZATION. I represent and warrant that I am physically fit and sufficiently healthy to participate in pickleball activities and competitive play. SSPL does not provide medical personnel at events. I am solely responsible for monitoring my own physical condition during play and for withdrawing if I feel unwell or at risk. I authorize emergency medical treatment in the event I am unable to provide consent, and I accept financial responsibility for any such treatment.

8. ALCOHOL AND IMPAIRMENT. I am solely and individually responsible for my own decisions regarding the consumption of alcohol or any other substance before, during, or after SSPL play. SSPL does not sponsor, organize, purchase, supply, or otherwise provide alcoholic beverages at any SSPL event. I shall not participate while impaired. SSPL reserves the right, in its sole discretion, to remove any participant who exhibits signs of impairment from active play, and such removal may be without refund. I release the Released Parties from any claim arising from my own choices regarding alcohol or substance use.

9. VENUE AND FACILITY CONDITIONS. I acknowledge that SSPL events are held at third-party facilities. I accept the conditions of each venue as-is and agree to inspect the playing area before participating.

10. EQUIPMENT RESPONSIBILITY. I am responsible for providing and maintaining my own equipment. SSPL is not responsible for the condition, suitability, or safety of my personal equipment.

11. PHOTO AND MEDIA RELEASE. I grant SSPL and its authorized representatives the irrevocable right to photograph, video record, and otherwise capture my likeness and voice during SSPL events for promotional, editorial, advertising, social media, and any other lawful purposes, without compensation, credit, or further approval required.

12. CODE OF CONDUCT. I agree to conduct myself in a sportsmanlike manner. SSPL reserves the right to remove any participant whose conduct is deemed disruptive, unsportsmanlike, or dangerous, without refund.

13. GOVERNING LAW AND SEVERABILITY. This agreement shall be governed by the laws of the state in which the applicable SSPL event is held. If any provision is found unenforceable, the remaining provisions shall continue in full force and effect.

14. ENTIRE AGREEMENT AND BINDING EFFECT. This agreement constitutes the entire agreement between me and SSPL regarding the subject matter herein. It shall be binding upon me and my heirs, executors, administrators, personal representatives, and assigns. I acknowledge that I have read this agreement in its entirety, that I understand its terms, and that I sign it voluntarily.

BY SIGNING THIS AGREEMENT, I ACKNOWLEDGE THAT I HAVE READ AND UNDERSTAND ITS TERMS. I AM AWARE THAT THIS IS A RELEASE OF LIABILITY AND A CONTRACT BETWEEN MYSELF AND THE SOUTHEAST SENIOR PRO LEAGUE AND ITS RELEASED PARTIES. I UNDERSTAND THAT BY SIGNING I AM GIVING UP MY RIGHT, AND THE RIGHT OF MY HEIRS AND ASSIGNS, TO SUE THE RELEASED PARTIES FOR ANY INJURY, LOSS, OR DAMAGE ARISING FROM MY PARTICIPATION IN SSPL ACTIVITIES, INCLUDING INJURY OR LOSS CAUSED BY NEGLIGENCE.
